Request for Prosecution Not In Custody
A Request for Prosecution Not In Custody is a request from a Law Enforcement Agency to the Prosecutor. If a Law Enforcement Agency determines that a crime was committed and if a subject has been identified and if the Law Enforcement Agency determines it is not necessary to arrest the subject and if the Law Enforcement Agency finds probable cause to request a complaint then the Law Enforcement Agency requests a complaint from the Prosecutor. The Request for Prosecution Not In Custody contains information about the reporting agency charges victim information and defendant information. The Request for Prosecution Not In Custody is one of 44 IEPDs developed by the California Department of Justice - Data Exchange Project to support information exchange between state and local government organizations throughout the state of California. It could also be adapted for use in other states.
